1. SCOPE OF APPLICATION OF THE TERMS.
These general terms and conditions apply to any delivery from Kverneland Energi AS, unless otherwise agreed in writing. Additions or deviations from these general terms and conditions must be agreed in writing and included in the agreement.
The terms apply together with the accepted offer. The purchase is governed by consumer legislation, including but not limited to, laws on consumer purchases, right of withdrawal, marketing, personal data and credit purchases.

Subcontractors
Kverneland Energi AS is entitled to have all or part of its contractual obligations performed by subcontractors. The parties’ contractual liability to each other is not thereby changed.
3. MARKETING AND SOCIAL MEDIA
The Customer grants Kverneland Energi AS the right to freely use images from the Customer’s property, the PV system and the installation process in marketing measures, including in social and paid media.
4. PRIVACY
Kverneland Energi AS processes personal data in accordance with applicable legal and regulatory requirements and in accordance with any measures taken by public authorities. Read more about how Kverneland Energi AS handles personal data in our privacy policy.
5. ORDERING AND AGREEMENT PROCESS
The order is binding when the offer from the Seller is accepted in writing by the Buyer. The offer must be read carefully. Errors or deficiencies that the Buyer realized or had to understand were misspellings do not under any circumstances provide a basis for any claim against the Seller. Reservations are made that typographical or printing errors may occur, which may mean that we cannot deliver according to information provided in our marketing or otherwise. Kverneland Energi reserves the right to change prices to take into account costs related to changes in exchange rates or other costs between the date of the purchase order and the delivery date. The Buyer shall pay any such increases in addition to the price set out in the Contract.
Furthermore, the Seller reserves the right to cancel your order or part of it if the product is sold out or cannot be delivered.
Termination by the customer
The customer can cancel the installation free of charge up to 21 days after the purchase agreement has been signed.
If the customer cancels the installation before the agreed start time, up to 10%.
If the customer cancels the installation after the agreed start time, the customer must cover expenses for work that has been carried out and that cannot be reversed.
Cancellation and termination by Kverneland Energi
Kverneland Energi may terminate the agreement or cancel the delivery free of charge if the installation cannot be completed due to circumstances beyond Kverneland Energi ‘s control that complicate the installation process or lead to increased costs.
6. GENERAL PRICE ASSUMPTIONS
Price quotations prepared by Kverneland Energi may not, without consent, be shown, copied or handed over to third parties.
Prices are based on the installation being carried out under normal conditions where the following assumptions apply:
- The building where the PV system is to be installed is ready and available on the agreed installation date. Please note that the actual installation date may be later than this, for reasons described below.
- Cabling from the roof to the inverter and/or fuse box must be carried out using the most practical and cost-effective route, with a maximum cable length of 50 meters.
- The inverter is installed and connected to the power grid in the same building where the solar panels are mounted, preferably outside or in the same or adjacent room as the fuse box.
- Hidden cabling, indoor or outdoor, is not included in the price.
- The use of optimizers is not included in the price, unless specified in the offer.
- Existing cable conduits are only used if this is suitable and appropriate for the equipment used in the project.
- The public grid and the grid in the house comply with current regulatory requirements and have sufficient capacity and quality for the PV system to be connected without further improvements or adaptations.
- The fuse box complies with applicable regulatory requirements and has sufficient space.
- The main fuse, electrical system and sub-distribution are adequately dimensioned.
- Installation is carried out on the building where the electrical inlet is located. In cases where the installation is carried out on another building, additional costs may be incurred as a result of the need for additional cabling and/or sub-distribution.
- The roof is watertight and in appropriate condition, and has a solid supporting structure suitable for the installation and fixing of the solar panels. If the roof or property is in such a condition that the installation of the PV system cannot be carried out safely without extensive repairs or building work, Kverneland Energi has the right to cancel the project without incurring liability and to charge the Customer for any expenses incurred.
- The roof is not covered with slate or grass.
- Installations with recessed solar panels, if offered, are priced separately and the price includes removal of roof tiles and other roofing material in the relevant panel area. When installing on a new roof, the battens must already be adapted and mounted.
- Special roof types, such as roofing materials containing asbestos, are priced separately. Kverneland Energi reserves the right to interrupt and cancel projects, at no cost to Kverneland Energi, on roofs with asbestos-containing materials.
- Voltage quality from the grid owner is within normal limits, including voltage from the photovoltaic system.
Necessary permits
- The Customer is responsible for obtaining the necessary permits and approvals from the relevant authorities before the PV system is installed. Such approvals may include building permits from the city or municipality, as well as an agreement with the Customer’s electricity supplier on the sale and purchase of surplus electricity.
- Kverneland Energi arranges electricity connection with the local grid owner.
Kverneland Energi can assist the Customer with information to help with any permit processes.
7. DURING INSTALLATION
- The Customer shall ensure that Kverneland Energi has unimpeded access to the Customer’s property in connection with the installation of the PV installation.
- Kverneland Energi shall have unimpeded access to water and electricity in connection with the installation of the PV system.
- The Customer shall remove all movable obstacles, clear snow and carry out similar measures that are necessary for access to the Customer’s property and performance of the installation.
- There must be no obstacles that restrict or impede access to the roof, such as colonnades, conservatories or similar. Extended installation time as a result of restricted access due to unmoveable obstacles that have not been disclosed may be invoiced to the customer.
- Cost increases resulting from limited access to the Customer’s property, electricity or water may be invoiced to the Customer in full.
8. CUSTOMIZATIONS AND CONFIGURATION
- Adjustments in size (e.g. number of panels) and configuration (e.g. panel type, power optimizers, inverter) may occur if special circumstances on the roof require a reduction of the area covered by the solar panels.
- Changes to the planned material and equipment for the installation may occur if this is necessary to facilitate changes and adaptations to the installation on site. The Customer accepts that such changes shall not be considered as faulty or defective delivery.
- Kverneland Energi tries to map out all necessary changes before the PV System is installed, but sometimes minor changes may occur during the installation work and the price will be reduced or increased accordingly. The Customer will be informed of such changes and must approve any price change that exceeds 5%.
9. DELIVERY AND COMMISSIONING AND DOCUMENTATION
- Delivery of the PV system means that all equipment is correctly and functionally installed and tested.
- The customer is responsible for ensuring that the power grid on the property is operational at the time of delivery.
- Commissioning of the solar PV installation, including start-up of power production, takes place after approval from local authorities, such as the local grid owner. In some cases, it will not be possible to commission the installation at the time of delivery, due to requirements from local authorities or grid owners.
- Some grid owners require the Customer’s electricity meter to be replaced before the photovoltaic system is put into operation. The grid owner has sole responsibility for this process, and Kverneland Energi AS has no responsibility for any delays in power production from the photovoltaic system due to the grid owner replacing the electricity meter.
- Kverneland Energi will help with the commissioning of the solar cell system after delivery.
- Kverneland Energi will provide the Customer with documentation on the PV installation. Documentation is delivered electronically, and includes product data sheets and user manuals and compliance documentation.
- The customer accepts that the solar cell system is complete when delivery has been completed and documentation has been handed over.
10. DATA AND CONNECTION
- Connecting the solar PV system to the internet requires that the Customer has available WiFi coverage where the inverter is installed and that the WiFi network’s name and password are made available to the installer during the installation.
- It is the Customer’s responsibility that the internet connection works and that the inverter(s) are configured with the correct password. Kverneland Energi is not responsible for troubleshooting in connection with internet connection.
- Kverneland Energi will assist the Customer in registering the PV installation on the inverter manufacturer’s web portal. The collection, storage and use of data on the manufacturer’s portal is subject to the terms and conditions stipulated by the relevant manufacturer and is solely a matter between the manufacturer and the Customer. The Customer also grants the inverter manufacturer the right to share data available on the online portal with Kverneland Energi. Customers who do not wish their PV system to be registered on the inverter manufacturer’s web portal must give express notice of this.
- Kverneland Energi has the right to collect, store and use production data from the PV installation at its own discretion.
11. SYSTEM CONDITIONS
- The photovoltaic system is balanced between the nominal DC power of the solar panels and the AC power of the inverter.
- The size and stated power of the system is associated with the nominal DC power from the solar panels.
- The installer will, as part of the design, assess which inverter is the best for the project. As most inverters are more efficient at high utilization, the inverter will in many cases be dimensioned somewhat lower than the nominal direct current from all the solar panels combined. This is done in order to optimize the plant’s annual energy development, and may result in the peak production from the PV plant on particularly sunny days being somewhat lower than would otherwise be possible.
- Noise from the PV system may occur as a result of cooling fans and/or switching components in the inverters.
12. SALE OF SURPLUS POWER
The customer owns the power produced by the PV system. Kverneland Energi AS is not responsible for the sale of surplus power.
13. GUARANTEE OF PERFORMANCE
- Kverneland Energi guarantees that the PV installation has the specified nominal DC power output, but gives no guarantee regarding the power production.
- The estimated power production provided by Kverneland Energi is based on system output and available solar radiation databases, climate data and information received about the installation site. Actual power production will vary over time and may be affected by local weather variations as well as shading from vegetation, adjacent buildings or other elements on site. Shading from building elements, adjacent buildings, vegetation or similar is not included in the calculations.
- All products are sensitive to wear and tear, which can lead to reduced performance and production over time. A reduction in power production as a result of normal wear and tear, or within the manufacturer’s stated data for maximum quality loss, must be expected.
- Any product warranty offered directly by the manufacturer is a matter between the Customer and the manufacturer. Please note that such product warranties may require the Customer to register the product in accordance with the manufacturer’s procedures.
The photovoltaic system is not the Customer’s primary source of electricity. Kverneland Energi is therefore not liable for losses caused directly or indirectly by power outages. If the power from the grid is lost, the PV system shuts down, in accordance with applicable regulations.
14. OPERATION AND MAINTENANCE
Operation and maintenance documentation is provided for the delivery where this has been agreed. Data sheets and product information accompanying delivered products are supplied. Kverneland Energi At the customer’s request, AS can provide documentation for products where this is not normally included. The customer is obliged to follow instructions for operation and maintenance. Kverneland Energi AS is not liable for damage, etc. as a result of improper use or maintenance of the delivery.
All work on the PV system must be carried out by authorized personnel. Kverneland Energi is not liable for losses caused directly or indirectly by, among other things, repairs and maintenance carried out by unauthorized personnel.
Kverneland Energi recommends taking out a service agreement for the solar cell system.
15. INVOICING AND PAYMENT
- Standard payment terms are prepayment. In the event of late payment, the Customer shall pay default interest in accordance with applicable legislation on late payment.
- Kverneland Energi AS has a vendor’s lien on the delivery for the offer price and for claims for any other services, in line with the rules in sections 314 to 322 of the Mortgage Act. As long as Kverneland Energi AS has a sales pledge in the delivery, the customer is responsible for keeping the equipment properly maintained.
- Kverneland Energi is not responsible for applying for or approving any national or local grants or subsidies on behalf of the Customer. Prices may be quoted gross or net of grant funds. The Customer is always liable for the gross price upon delivery of the PV installation.
16. WARRANTY AND COMPLAINTS
Our warranties do not imply any limitations on the right to complain about goods in accordance with the Sale of Goods Act and the Consumer Purchase Act.
The Buyer may not, on its own initiative, initiate measures to rectify a defect in the installation. If this is done, the warranty on the installation will be terminated.
The warranty period starts upon completion of the photovoltaic system in accordance with section 9 of these terms and conditions.
17. FORCE MAJEURE
Kverneland Energi shall not be liable for delays in deliveries, or for failure to deliver or perform, in whole or in part, caused by circumstances beyond the control of Kverneland Energy or Kverneland Energy’s suppliers, including but not limited to, any one or more of the following: fire, strike; lockout; labor disputes; epidemics; flood; accident; transportation delays; war; trade blockade; restraining orders of any court or judge; or any other reasonable cause, whether similar or dissimilar to those already mentioned herein. The occurrence of any such cause or causes of delay shall extend the time for performance by the time or times of any cause or causes of delay.
18. DISPUTES
These terms and conditions and all related contracts of sale are governed by Norwegian law. Every effort shall be made to resolve disputes concerning this contract amicably. If amicable resolution of disputes is unsuccessful, Stavanger District Court is the venue for any disputes that may arise.
